A RESOLUTION DECLARING AN EMERGENCY WITHIN THE VILLAGE OF ANGEL FIRE, NEW MEXICO
WHEREAS, beginning in December, 2019, a novel coronavirus, now designated COVID-19, was detected in Wuhan City, Hubei Province, China and has since spread throughout the world; and
WHEREAS, extraordinary measure must be taken to contain COVID-19 and prevent its spread throughout the Village of Angel Fire, including the isolation and potential quarantine of groups of individuals, and property, and additionally, including compelling individuals, groups of individuals, or property to undergo additional health measures that prevent or control the spread of the virus; and
WHEREAS, by statute via Executive Order 2020-004, on the 11th day of March, 2020, the State of New Mexico has provided for the declaration of an Emergency as defined in New Mexico Statutes Annotated (NMSA) 1978, § 12-10-1 through 12-10-10, All Hazard Emergency Management Act ordering all political subdivisions within New Mexico to adhere to Section 12-10-10, which mandates compliance with and enforcement of said Executive Order; and
WHEREAS, Executive Order 2020-004 further proclaims a public health emergency in accordance with NMSA 1978, § 12-10A-5 of the Public Health Emergency Response Act declaring that all political subdivisions within the State of New Mexico are affected by the COVID-19 outbreak and, to the extent permitted by law, are subject to the provisions of said Executive Order; and
WHEREAS, the Cabinet Secretary of the New Mexico Department of Health by the legal authority pursuant to the Public Health Act, NMSA 1978, § 24-1-1 to 24-1-40; the Public Health Emergency Response Act, NMSA 1978 § 12-10A-1 to 12-10A-10; the Department of Health Act; NMSA 1978 § 9-7-1 to 9-7-18; the authority granted in EO 2020-004, and in any inherent constitutional police powers of the New Mexico state government, to preserve and promote public health and safety, to adopt isolation and quarantine, and close public places and forbid gatherings of people when deemed necessary by the Department of Health for the public health, has issued such Public Health Orders; and
WHEREAS, the COVID-19 virus is a condition of danger to the health, welfare and economic well-being of the citizens of the Village and may result in an interruption of municipal services affecting the public peace, property, health and safety of our citizens; and
WHEREAS, the governing body of the Village has made such observations, inquiries, and investigations necessary to determine that an Emergency exists under the law of the State of New Mexico and the Code of the Village of Angel Fire; and
WHEREAS, it is necessary and appropriate for the governing body to exercise authority granted by the New Mexico Constitution, NMSA 1978 and the Village Code to minimize the immediate and significant danger to health, safety, economic well-being and welfare of the citizens of the Village of Angel Fire.
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Village of Angel Fire by this Resolution declare as follows:
By virtue of the authority provided by local ordinances and by NMSA 1978 § 12-10-1 through 12-10-10, the All Hazard Emergency Management Act; we do hereby declare Angel Fire to be an emergency area as a result of COVID-19 for the purpose of exercising necessary emergency powers and expenditure of available resources, and requesting aid, assistance, and relief programs and funds available from the State of New Mexico and the federal government of the United States; and
All Village public events, trainings and non-Council meetings and all such events, planned to be held in or on Village property are hereby cancelled until further notice, with the status to be reviewed periodically in addition to reviews at such times as the Governor of the State of New Mexico rescinds, renews or otherwise extends Executive Order 2020-004; and
This Resolution activates the Village of Angel Fire Emergency Operations Plan to that extent it has not already been activated; and
The Village shall follow and support efforts made by the Colfax County Emergency Management officials and operate in cooperation with the county wide emergency management plan; and
Any individual, group of individuals, or property subject to an Order from the New Mexico State Department of Health restricting the movement of that individual or group of individuals or restricting movement to, from, or within that property, shall limit ingress and egress and take such measures as specified by those Orders; and
The Village Manager may implement all necessary and proper measures to allow for flexibility of time and location of work, including offsite, telecommuting and administrative leave for employees during the period of this emergency; and
This Resolution of an emergency shall be given prompt and general publicity and shall be filed properly with the Village Clerk’s Office.
